This Privacy Notice (“Notice”) describes how BrüMate LLC, its divisions, subsidiaries and affiliates, (together, “BrüMate,” “we,” “our” or “us”) may collect, use and disclose the Personal Information we collect from you or about you in the context of your relationship with us; the choices you have regarding our use of your Personal Information; and how to contact us regarding our privacy practices.

This Notice covers the Personal Information we collect from you, or about you, including when you:

  • Visit and interact with our websites that link to this Notice (the “Websites”);
  • Purchase products from us;
  • Use and interact with our mobile applications (“Apps,” together with the Websites, the “Services”);
  • Visit our stores, experience centers, or showrooms; and
  • Otherwise provide Personal Information to us, whether offline or online in the context of your relationship with us.

As used in this Notice, “Personal Information” is information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you, your household or your device.

Before engaging with us or submitting Personal Information to us or using our Services, please review this Notice carefully. If you are an employee or job applicant, this Notice does not apply to you in the context of those relationships, and to the extent required by law, our privacy practices are set out in our separate employee policies, job postings or our agreements with you, as applicable.

  • Directly from you, such as when you complete our online forms, order a product, enter a contest or participate in a survey, or otherwise engage with us;
  • Through use of cookies and automated technologies that we have installed on the Services and our other digital content that links to this Notice. For more information on our use of cookies and similar technologies, please review the “Cookies and Tracking Technology” section below; and
  • From third parties. We may obtain your Personal Information from third-party sources, such as marketing partners, other consumers (e.g., someone who refers you to us), service providers, and social media companies.

Over the past 12 months, we may have collected the following Personal Information from or about you:

  • Identifiers, such as your name, date of birth, postal address, telephone number, email address, IP address, and other contact information.
  • Information subject to protection under California law, such as the Identifiers above and our service providers may collect your credit card or debit card number.
  • Commercial information,such as your purchase history, payment information including credit card numbers, and product reviews.
  • Internet activity information,such as your IP address, device ID, device, or browser type, and browsing behavior.
  • Geolocation data, such as your location inferred from your IP address, and other technologies to determine the approximate location of the devices from which you interact with us.
  • Audio or visual information,you voluntarily submit to us for customer service purposes or reviews.
  • Sensitive Information, including your driver’s license, specific geolocation data, and billing and credit card information.
  • Inferences, based on the information above to create profiles based on your purchasing habits.

We may disclose each of the above categories of information with the parties described in the “How We Disclose Personal Information” section below or as otherwise required by law.

We use Sensitive Personal Information for legitimate business purposes, including to (i) perform services or provide goods reasonably expected by an average person; (ii) detect security incidents; (iii) resist malicious, deceptive or illegal actions; (iv) ensure the physical safety of individuals; (v) for short-term, transient use; (vi) perform or provide internal business services; or (vii) verify or maintain the quality or safety of a service or device. We do not sell or share (as defined under California law) any Sensitive Personal Information

We may use your Personal Information to:

  • Provide You Products and Services: We use your Personal Information to provide you products and support, including to process your transactions and payments and fulfill your orders; create and administer your account; and communicate with you in relation to providing you products.
  • Build and Maintain Our Relationship with You: We use your Personal Information to improve your experience on our Services; understand your preferences and send you promotional messages and advertisements about products you may like; communicate with you about products and events you may be interested in; send you surveys; and provide you customer service. We may also draw inferences from the Personal Information you provide directly to us such as information about your preferences and characteristics.
  • Improve and Maintain Our Services and Our Product Offerings: In order to improve your experience, maintain our Services, and provide you with products that you are interested in, we use your Personal Information to understand who is visiting our Services, analyze how the Services are being accessed and used, improve the functionality of our Services and develop new product and service offerings.
  • Maintain the Security of Our Services: To maintain the security and integrity of our Services, we use your Personal Information to detect security incidents, protect our Services against fraudulent and illegal activity and enforce our terms of use.
  • Comply with Our Legal Obligations and Respond to Legal Proceedings: We use your Personal Information to comply with our legal, regulatory and risk management obligations and maintain records of our compliance with federal and state law requirements. We may also use your Personal Information to establish, exercise or defend legal claims, such as to prevent fraud.

In the past 12 months, we may have disclosed Personal Information in specific situations described in this section and/or with the following categories of third parties:

  • Service Providers. We may use third-party service providers to help us operate our business or to administer activities on our behalf, such as sending emails, providing order fulfillment and payment processing, and conducting marketing or customer service. These third parties may process Personal Information for those business purposes.
  • Marketing Partners. We may disclose your Personal Information to provide you with personalized advertisements.
  • Business Transfers. We may disclose information that we collect from you to an Affiliated Entity or a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including without limitation in connection with any bankruptcy or similar proceedings).
  • Legal Requirements. We may disclose your Personal Information as we believe to be necessary or appropriate: (i) under applicable law, which may include laws outside your country of residence; (ii) to comply with the request of a law enforcement or regulatory agency (including agencies outside your country of residence) or other legal process; (iii) to protect our operations or those of any of the Affiliated Entities; (iv) to protect the rights, privacy, property, interests or safety of BrüMate, the Affiliated Entities, Services visitors, customers, business partners, employees or the public; (v) to permit us to pursue available remedies or limit the damages that we may sustain; (vi) to enforce our Terms of Use; or (vii) to respond to an emergency.
  • Other Third Parties. We may disclose Personal Information to unaffiliated third parties with your consent.

We may use cookies and other tracking technologies (like web beacons and pixels) to access or store information. A “cookie” is a small text file that is placed on your computer or mobile device when you enter a website or a mobile app. It enables the website or mobile app to remember your actions and preferences over a period of time.

To learn more about cookies and other technologies, please visit www.allaboutcookies.org. Most web and mobile device browsers automatically accept cookies. If you prefer, you can change your browser to prevent that or to notify you each time a cookie is set.

In particular, we may collect information automatically:

  • Using pixel tags and other similar technologies. Pixel tags (also known as web beacons and clear GIFs) may be used in connection with some Services to, among other things, track the actions of users of the Services (including email recipients), measure the success of our marketing campaigns and compile statistics about usage of the Services and response rates.
  • Using Google Analytics. With your consent, we use Google Analytics, a Google service that uses cookies and other, similar technologies to collect and analyze information about use of the Services and report on activities and website trends. You can learn about Google’s practices in connection with this enhanced tracking and opt-out of it by visiting www.google.com/settings/ads or by downloading the Google Analytics opt-out browser add-on, available at https://tools.google.com/dlpage/gaoptout.

Cookie management: You have the ability to accept or decline cookies. Most browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the interactive features of the Website.

You can use the methods described below to manage cookies. You must take these steps on each browser or device that you use. If you replace, change or upgrade your browser or device, or delete your cookies, you may need to use these opt-out tools again.

Some web browsers have “Do Not Track” or similar features that allow visitors to tell each website they visit that they do not want their activities on that website tracked. There is no uniform standard for implementing and recognizing “Do Not Track” signals. For that reason, at present, our Websites do not respond to “Do Not Track” signals.

Global Privacy Control (GPC) allows individuals to automatically signal their privacy preferences to websites and other online services through their browser or through an extension. If we receive a GPC signal to opt-out of website tracking, we will honor such requests.

We do not sell Personal Information for monetary consideration. However, our use of certain website tracking-technologies may meet the definition of “selling” or “sharing” as that term is defined by applicable law. Residents of certain states may be eligible to opt-out of this information use. Please see the California and other state privacy law sections of this Notice for more information. We have no actual knowledge that we sell or share the Personal Information of anyone under the age of 18.

We will store your Personal Information for no longer than is necessary for the performance of our obligations or to achieve the purposes for which the information was collected, or as may be permitted under applicable law. To determine the appropriate retention period, we will consider the following: the amount, nature and sensitivity of the data; the potential risk of harm from unauthorized use or disclosure of data; the purposes for which we process the data; whether we can achieve the purposes through other means; and the applicable legal requirements.

  • Opting-Out of Marketing Email: You can unsubscribe from our marketing and promotional communications by clicking on the unsubscribe link in the emails that we send. Even if you opt-out of marketing, we may still communicate with you; for example, to send you service-related messages that are related to the administration and use of your account, to respond to service requests, or for other non-marketing purposes.
  • Opting-Out of SMS and Phone Marketing: You may have the opportunity to receive occasional voice, text and SMS messages from us. These are updates on our products and services, or about products and services that we think may be of interest to you. Frequency will vary. By providing your phone number and opting in to receive text messages, you expressly consent to receive these communications. This includes automated text messages to the phone number that you provide. Consent to receiving text messages is not required to receive products or services from BrüMate. Message and data rates may apply, and your carrier's rates will apply. You can opt-out of receiving future text messages or receive help by following the directions in the text message you receive. As we are in the United States, international rates may apply depending on your location. We may disclose your mobile phone number to service providers with whom we contract to send you automated text messages. However, we will not disclose your mobile phone number to third parties for their own marketing purposes without your express consent.

We may offer financial incentives to consumers in exchange for sharing certain Personal Information with us. Participation and the rewards offered as incentives are set out within each program. Our good-faith estimate of the value of your information is the value of the benefit we offer to you. We calculate that value by using the expense to us of operating the program related to the benefit obtained by our running of the program. You can opt-in by signing up for the incentive when it is offered to you . Participation is always optional, and you can opt-out of participating at any time as explained in the applicable program terms. Our Services may contain references and/or links to third-party websites and services, including references and links to third parties that accept and process your payments to us. We are not responsible for any third party’s data collection or privacy practices, and we have no control over what information third parties track or collect. Any access to and use of such linked websites is not governed by this Notice but instead is governed by the privacy policies of those third-party websites. We encourage you to review the privacy policies posted on those third-party websites for further information.

We have implemented reasonable technical and organizational security measures designed to protect the security of any Personal Information we process. We have also taken steps to ensure that the only personnel who are granted access to your personal data are those with a business ‘need-to-know’ or whose duties reasonably require such information.

However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be entirely secure.

The Services are not directed to children under the age of 18, and we request that children do not provide Personal Information through the Services. If we learn that Personal Information from users less than 18 years of age has been collected, we will take reasonable measures to promptly delete such data from our records. We may occasionally update this Notice to reflect changes in our practices. When we post modifications to this Notice, we will revise the “Effective Date” at the top of this Notice. If we make material changes to this Notice, we shall, to the extent required by applicable law, notify you by prominent posting on our online services, email to your registered email address, or through other appropriate communication channels. All changes shall be effective from the date of publication unless otherwise provided in the notification.

These Additional California Privacy Disclosures supplement the information contained in the Privacy Notice. These Disclosures apply only to individuals residing in California.

The types of Personal Information we collect can be found in the “What Information We Collect” section of the Privacy Notice.

The manner in which we collect that information is described in the “How We Collect Your Personal Information” section of the Privacy Notice.

We may use and disclose Personal Information for the business and commercial purposes detailed in the “How We Use Your Personal Information” and “How We Disclose Personal Information” sections of the Privacy Notice.

We retain your information as described in the “Retention of Personal Information” section of the Privacy Notice.

We have not sold consumer information for any monetary value. However, our use of cookies, and tracking technologies may constitute “sharing” under certain U.S. state consumer privacy laws. We have sold or shared the following categories of Personal Information with our targeted advertising service providers and partners: Identifiers, Geolocation Data, and Internet Activity Information. We do not knowingly sell the Personal Information of minors under 18. Shine the Light

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of Personal Information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties to which we disclosed Personal Information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.

Your California Rights

If you are a California resident, you may have the following rights with respect to the Personal Information we process about you:

  • Right to Know and Access.You may have the right to request information about the categories of Personal Information we have collected about you, the categories of sources from which we collected the Personal Information, the purposes for collecting, selling, or sharing the Personal Information, and the categories of third parties to whom we have disclosed your Personal Information, and the specific pieces of Personal Information we have collected about you.
  • Right to Delete.You may have the right to request that we delete Personal Information that we have collected from you.
  • Right to Correct.You may have the right to request that we correct inaccurate Personal Information that we maintain about you.
  • Right to Opt-out of Sales or Sharing. You may have the right to opt-out of the “sale” or “sharing” of your Personal Information as such terms are defined by the California Consumer Privacy Act.
  • Right to Non-Discrimination. Should you choose to exercise any of these rights, we will not discriminate against you in any way. If you exercise certain rights, understand certain features of the Services may be unavailable to you.

Exercising Your California Rights

For instance, depending on the type of request you submit, we may ask you to provide certain information so that we can match the information you provide with the information we already have on file, or we may contact you through a communication method (e.g., phone or email) that you have previously provided to us. We may also use other verification methods as the circumstances dictate.

We will only use Personal Information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification. If, however, we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity, and for security or fraud-prevention purposes. We will delete such additionally provided information as soon as we finish verifying you.

  • Right to Appeal. If we do not grant your consumer request, you may have the right to appeal that denial.

Submitting a Privacy Rights Request

Making a consumer request does not require you to create an account with us. Applicable law may limit the number of times that you can submit a particular request within a 12-month period.
